What is family mediation?
It is an amicable resolution process in which the parties, with support, negotiate an agreement on the consequences of the separation (children, home, assets). The agreement is then secured legally, and ratified by the judge for a divorce.
What is the difference with collaborative law?
Collaborative law is a structured form of negotiation in which each party is assisted by their lawyer, committed to finding a solution without referring the matter to the judge. Maître Cora Maglo is trained in it, an approach still rare in Luxembourg.
Is mediation suitable when there are children?
Yes, particularly. It makes it possible to organise the residence, the right of access and the contribution to maintenance in the child’s interest, while preserving a workable relationship between the parents.
Does mediation replace the lawyer?
No. The lawyer supervises the agreement, checks its balance and validity, and translates it into enforceable instruments. Amicable tools complement the lawyer’s advice, they do not replace it.
What happens if mediation fails?
If no overall agreement is reached, the contentious route remains open. The firm then represents you in a divorce for irretrievable breakdown of the marital relationship, protecting your interests.
Is mediation less costly than a trial?
